Terms and conditions.
1) Object and Description
These general conditions of sale apply between:
the “Ddog Mannequins” represented by the company Divas S.r.l. (BO Business Register – R.E.A. 415438) . Registered office: Via dei Pellicciai 1 – 40050 Argelato (BO), Italy. VAT number: IT02118911201. Hereinafter «Ddog Mannequins»
And
The “Customer” who visits and makes purchases from the website www.ddog.it, hereinafter “Site”, based on the following general conditions of sale. The Customer , hereinafter “Customer”, can be either the natural or legal person who acts for purposes directly related to the professional activity carried out, or the natural person who acts for purposes not directly related to the professional activity carried out.
Ddog Mannequins and the Customer are therefore the Parties stipulating the contract, hereinafter “Parties”. Contract means the distance contract having as its object the sale of products governed by these general conditions of sale, hereinafter “Contract”.
These conditions identify the general conditions to be applied to all orders sent by the customer to Ddog Mannequins, electronically, and to contracts, present and future, always stipulated electronically with the latter for the purchase of products on the website www.ddog .it. By Order we mean the request form for the goods offered for sale completed by the customer through the Site, hereinafter “Order”.
Specifically, the conditions regulate all the phases aimed at the conclusion of the electronic contract and the events that may affect it after its conclusion.
Part of these conditions is also reserved for the regulation of the contents of the website www.ddog.it and the rights, including intellectual property rights, on the same.
Access and use of this Site www.ddog.it, as well as the purchase of the “products” on the same, are based on the assumption that these general conditions of Sale have been read, understood and implicitly irrevocably accepted by the Customer . By Products we mean the goods present on the Site and offered for sale based on the following general conditions, hereinafter «Products»
Total Price means the consideration for the sale of the goods including shipping costs, hereinafter «Total Price»
The general conditions may be subject to changes or additions over time, it is however understood that the conditions applicable to the sale will be those in force on the date on which the order was placed by the customer on the website www.ddog.it. To purchase one or more products on the website www.ddog.it it is necessary to first create your customer profile by giving consent to the processing of your personal data.
The Customer will be responsible for any improper or unauthorized use of the website www.ddog.it and its contents. Therefore Ddog Mannequins will not be considered responsible for any use of the site and its contents made by the Customer in violation of these conditions of laws or regulations in force or in any case which has not been previously authorized by Ddog Mannequins in writing.
2) Products
The Products are sold according to the terms and conditions set out in the Contract published on the Site at the time of the Order.
The products offered for sale by Ddog Mannequins are those depicted on the website www.ddog.it on the day the customer consults the site. The characteristics of the products offered for sale are described with the greatest possible degree of precision. However, if errors or omissions should occur in the presentation, these cannot be charged to Ddog Mannequins as the images and texts illustrating the products have a merely indicative value and have no contractual value.
On the Site, “Products” manufactured and customized specifically at the Customer’s request may be offered for sale, the creation of which is subject to the payment of a deposit. The right of withdrawal from the Purchase Contract of the aforementioned Personalized Products will not be permitted. in the case of purchases subject to a deposit and not collected within 90 days of goods availability, the order will be considered canceled and the amount paid will not be returned and will be retained as compensation for damages.
Ddog Mannequins reserves the right to modify its products on the site at any time without notice.
3) Prices
The Prices visible on the Site are indicated in euros (€) and are intended to exclude the Value Added Tax (VAT) in force for the respective product categories to which they belong; Shipping costs are charged to the customer.
The Total Price resulting at the end of the purchase procedure must be understood as including VAT (where applicable) and shipping costs, but not any customs duties and additional sales taxes necessary for importing the goods into foreign territory. Any additional charges relating to customs clearance operations must be borne exclusively by the recipient of the shipment.
Ddog Mannequins reserves the right to change its prices on the Site at any time. The products will be invoiced based on the prices in force on the site at the time the order is registered.
4) Order
By sending the order the Customer declares:
- to have read and irrevocably accepted these General Conditions of Sale, including the attached Privacy and Cookie Policies.
- to expressly and irrevocably accept the prices and descriptions of the products available for sale, identified on the website www.ddog.it and to have considered them complete and exhaustive.
- to have the capacity to conclude this contract and to be of age.
The purchase of products from the Site presupposes the release by the Customer of the data necessary to carry out the Product delivery activities. For the purposes of registration, required only at the time of purchase, the Customer undertakes to communicate correct and truthful data relating to personal details, personal contact details, tax code and in general all other information useful for processing the order;
To purchase one or more products on the website www.ddog.it it is necessary to enter and give consent to the processing of your personal data.
The customer will be held responsible in the event of communication of information and data that are incorrect, false or relating to third parties (in the event that the third parties have not given their consent) as well as for any improper use of such data or information .
The order will not be definitively received and/or registered by Ddog mannequins unless the order is sent and payment is validated. Subsequently, the order is considered irrevocable and non-modifiable.
When the order is registered by Ddog Mannequins, an email will automatically be sent to the Customer at the email address indicated by him. This first email represents confirmation that the order has been “taken over” by Ddog Mannequins.
The Contract will be considered concluded, and binding for both Parties, when a second email with the “order confirmation” is sent by Ddog mannequins to the email address indicated by the Customer. The information relating to the order placed will be summarized in the order confirmation.
The goods will be invoiced by means of a regular accompanying invoice at the time of shipment.
5) Payment Method
Payment of the Total Price must be made in full at the time the order is processed. The payment methods accepted by www.ddog.it are: credit card debit or bank transfer.
- Credit Card: The credit card must belong to the Visa, Mastercard, Visa Elektron, Maestro, Vpay circuits. In cases of purchasing goods with this payment method, the debit occurs at the conclusion of the online transaction. The Customer authorizes Ddog Mannequins to debit from his account and “subject to collection” the amounts relating to the products purchased on the site using his indicated credit card.
- Bank transfer: the payment method via bank transfer (in advance) provides that the order is processed only after payment has been made by the Customer and Ddog Mannequins has received the availability in the bank.By choosing this type of payment, once the order has been placed the customer will automatically receive an email from Ddog Mannequins confirming receipt of the order sent, then it is necessary to follow the following procedure: 1) the reason to be reported on the bank transfer must indicate: the number and date of the order, the name and surname of the person making the order or the company name; 2)the bank transfer must be made to Divas srl and the data to perform the transfer will be communicated in the order confirmation email sent to the Customer. Banking procedures require that the transfer made be credited to the beneficiary’s current account (Divas srl) no earlier than 2/3 working days after execution, consequently the days between the date of placing the order and the date on which the Customer will prepare the bank transfer. After 7 days from the date of acceptance of the order without Ddog Mannequins having received credit for the bank transfer, the order will be cancelled.The (sales) contract is intended to be effective “subject to collection”, i.e. Ddog Mannequins reserves the right to terminate the contract in the event that the payment is not credited. In this case Ddog Mannequins may legally terminate the relationship with the User by virtue of these conditions.
6) Payment Security
In order to guarantee payment security, Ddog Mannequins uses the protected and secure Pago on Line Carte di Unicredit Banca circuit, a security guarantee for credit card purchases. The service guarantees the confidentiality of the transfer of payment card data via the Internet, thanks to the use of the 128Bit symmetric key SSL3.0 protocol.
7) Terms of Delivery, Delivery cost
Except in cases of force majeure, the delivery terms will be those indicated below. Ddog mannequins cannot be held responsible for any delays in delivery, whatever the cause, except for willful misconduct or gross negligence. It follows that no request for compensation of any nature can be made by the customer against Ddog Mannequins.
Ddog mannequins will arrange for the Products to be delivered to the address indicated by the Customer in the Order, using the help of a courier; DDog Mannequins reserves the right to choose the courier.
Delivery of the Products will take place within 24/48 hours for Italy and within 7 working days in EU territory, from the shipping date which will be made, in the case of products available in stock, within 24/48 hours of receipt and registration by of Ddog mannequins of the Order.
The delivery dates indicated on the Site are purely indicative and not binding for Ddog mannequins, at the same time the company cannot be held responsible for delays due to the courier or due to force majeure.
In the event that one or more Products are no longer available following the Order, Ddog Mannequins may proceed with the delivery of the other products ordered by the Customer; in this case, partial delivery of the ordered products is considered valid and does not give the Customer the right to refuse delivery, nor to any compensation or compensation of any kind.
Ddog mannequins reserves the right to inform the customer of any supplements for shipments abroad and/or particular locations such as: Livigno, Venice, islands, etc. The customer can accept the new conditions or choose to use their own courier. In the latter case, if payment has already been made, the customer will be able to receive a refund for shipping costs.
To protect the Customer, we only use insured Express shipments.
Upon delivery of the products, the Customer is required to check that the number of packages delivered corresponds to that indicated in the transport document; that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).
Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected and contested by the Customer by placing a written control reservation on the Courier’s proof of delivery. It is understood that, once the delivery document has been signed without any dispute, the Customer will no longer be able to raise any complaints to Ddog Mannequins with reference to the external characteristics of what was delivered. In the event that the delivery has been accepted with an unauthorized signature or there is evidence of tampering with the package, the customer is asked to immediately report the incident to the courier’s local office and contact us by sending an email at info@ddog.it
In case of non-delivery for various reasons (e.g. incorrect address and/or telephone number provided by the recipient; repeated absence of the recipient, etc.) the amount to cover the costs of sending the goods + returning the goods will be withheld and charged to the customer. In case of return of goods Ddog Mannequins will contact the customer to establish how to complete the contract.
Shipping costs are borne by the Customer except in cases expressly authorized by Ddog Mannequins in writing.
8) Returns & Exchanges
The right of withdrawal, in compliance with the provisions of Italian Legislative Decree No. 206 of 6 September 2005, consists in the Customer’s right to withdraw from the Contract within 14 days of receipt with consequent reimbursement of the amount paid.
The right of withdrawal applies only to persons acting for purposes not directly related to any professional activity carried out, therefore purchases made by retailers, companies or professionals are excluded from the right of withdrawal;
Therefore for the “Customer”, understood as a reseller, company or in any case professional, the right of withdrawal is not contemplated.
The right of withdrawal is exercised by sending, within the established deadlines, a written communication to the headquarters of Ddog Mannequins by registered letter with acknowledgment of receipt. The communication can also be sent, within the same deadline, by e-mail, provided that it is confirmed by registered letter with acknowledgment of receipt within the following forty-eight hours.
In the event that the Customer receives defective goods, or that errors occur in shipments by Ddog mannequins, the customer will have the right to request replacement or repair by sending photographic evidence of the defect to be sent via email to the address info @ddog.it within 3 working days of receiving the goods. An essential condition for exercising the right of return with replacement is the return of the purchased products in the original packaging; all returned products must be carefully packaged in order to safeguard the contents and avoid further damage. The goods must be returned to: Ddog mannequins by Divas srl, Via Dei Pellicciai 1, 40050 Argelato (BO).
Once the aforementioned deadline has passed, the products delivered will be considered definitively accepted by the Customer, consequently for complaints after this deadline Ddog Mannequins reserves the right to refuse or accept the relevant exchange of the products.
Each item must however be returned including all original labels, packaging and accessories received with the order.
The reasons given for the return/exchange must be justified in writing and accepted by Ddog Mannequins.
Ddog Mannequins reserves the right to request digital photographic evidence before authorizing returns for faulty merchandise.
Ddog mannequins reserves the right to refuse unauthorized returns or returns that do not comply with all the conditions above. In these cases the goods will be returned to the sender at the original shipping address and the shipping costs will be borne by the customer.
The Customer has also the possibility to ask the replacing of the product received with another item of the same or higher price.
The return of the item can be carried out by the Customer exclusively upon presentation of the purchase invoice
9) Personal data protection
The information relating to the processing of personal data is contained in the privacy information section of which the Customer declares to have read and accepted the conditions at the time of signing the order.
All Customers are invited to read the Privacy Policy which also applies if you decide to access the Ddog Mannequins website and use the services available on it without making any purchases. The Privacy Policy clarifies the methods and purposes for which Ddog Mannequins collects and uses Customers’ personal data.

The data communicated by the Customer necessary for the regular execution of the Contract will be processed in accordance with the provisions of Legislative Decree 2003 n. 196 regarding “Protection of personal data”. The data provided will not be used to send advertising and promotional material and will not be transferred to third parties. For these activities, the express consent of the owner is required, a consent that must be expressed during the purchase phase in order to proceed with the order.
Rights of interested parties
Pursuant to art. 7 of Legislative Decree no. 196/2003, the subjects to whom the personal data refer can at any time obtain:
- confirmation of the existence or otherwise of the data itself;
- know its content and origin;
- verify its accuracy or request its integration or updating;
- ask for it to be rectified.
Pursuant to the same article, interested parties have the right to:
- request cancellation;
- transformation into anonymous form;
- blocking of data processed in violation of the law;
- oppose in any case, for legitimate reasons, their processing.

10) Intellectual Property
All elements published on the Ddog Mannequins website, by way of example but not limited to: information, texts, trademarks, logo, models, distinctive signs, images and sounds, videos and music, menus, pages web, graphics, colors, patterns, tools, fonts, site design, diagrams, layout, methods, processes, functions are protected by copyright, trademark law and all other rights intellectual property of the Divas srl company.
These are the exclusive property of the Divas S.r.l. company. which may therefore take any legal action against those who, directly or indirectly, violate its intellectual property rights. The use or reproduction, even partial, of any element contained on the site is prohibited.
The use of trademarks, logos and other distinctive signs is prohibited, including reproduction on other websites by unauthorized third parties,
11) Content Disclaimer
Ddog Mannequins undertakes to prevent the publication on the website www.ddog.it of contents that describe or represent situations of physical or psychological violence or which, according to the sensitivity of the users, could be considered a violation of beliefs or civil rights and/or harmful to dignity, in all its forms and expressions.
In any case, Ddog Mannequins cannot guarantee that said contents are appropriate or lawful in countries outside Italy.
If such contents are considered illicit or illegal in some of these countries, the customer is invited not to access the site www.ddog.it.
By accessing the site and using the services provided by Ddog mannequins, the customer will be exclusively and personally responsible.
Ddog mannequins takes measures to ensure that the content of the site is as accurate, up to date and verified as possible.
12) Responsibility and Mejor Force
Ddog mannequins assumes, in all phases of contact with the Customer, from access to the site, to the order process, to shipping or after-sales services, a middle obligation. Therefore, Ddog Mannequins cannot be held responsible for any inconveniences or damages inherent and deriving from the use of the internet, by way of example and not exclusively, reference is made to: an interruption of service, an external intrusion, the presence of computer viruses or events qualifying as force majeure in accordance with jurisprudence.
The parties will not be liable for delay in performing their obligations under the Contract if such delay is caused by circumstances beyond their reasonable control. The Party in delay due to force majeure will be entitled to an extension of the deadlines necessary to fulfill these obligations;
Specifically, Ddog mannequins cannot be held responsible for any failure to fulfill its contractual obligations if this is due to fortuitous circumstances or force majeure, including, by way of example and not limited to, strike, fire, catastrophe, damage and in general any event that prevents the proper execution of orders.
13) Warranty
Regarding defective products, the User may use the law relating to them by returning the product within the terms set forth in these conditions. Ddog Mannequins reserves the right to assess the existence or otherwise of such defects and, if so, to replace or repair the defective product.
14) Integrity
In the event that any provision of this contract was declared void by a change in the law or by court, this does not affect the validity and compliance with these general conditions of sale.
15) Duration
These conditions will apply for the entire duration of the online availability of the services offered by Ddog Mannequins. The general terms and conditions of sale may be updated to make them compliant with new laws or regulations or for internal reasons of the company. The new terms and conditions will be effective from the date of publication on the website www.ddog.it.
16) Applicable law and protection of rights
These general terms and conditions of sale are governed by Italian law and in particular by the legislative decree of 6 September 2005, n.206 on distance contracts and by the legislative decree of 9 April 2003, n.70 for aspects concerning electronic commerce.
In case of disagreement, the parties undertake to try to resolve any disputes out of court.
For any dispute arising from the Contract or relating to it, the following will be competent: a) the Court of the Customer’s place of residence or domicile if the Customer is a final consumer pursuant to current legislation; b) exclusively the Court of Bologna, Italy, in any other case.
17) Rights
All products are subject to rights in favour of Ddog Mannequins until full payment of the price.
I declare that I have read and accept the conditions of sale.
For all the purposes of articles. n.1341 and n.1342 of the Italian Civil Code the User expressly accepts the content of Articles 2, 3, 4, ,5 , 7, 8, 9, 13, 14,16, 17 of these general conditions of sale.
